2027 Season Deposit Policy & Terms
2027 Season Deposit Policy
To be considered for a Mary Margaret Designs installation during the 2027 season, prospective clients must submit a non-refundable deposit. Please read the following terms carefully before submitting payment.
1. DEPOSIT DOES NOT GUARANTEE PLACEMENT
Submission of a deposit reserves your place in the applicant pool for the 2027 season. It does not guarantee that you will be selected as a client or that a design/installation will be performed. Acceptance is at the sole discretion of Mary Margaret Designs and is subject to availability, scheduling, and school eligibility (see below).
2. School Eligibility for 2027
For the 2027 school year, Mary Margaret Designs will provide installation services exclusively for students attending:
The University of Alabama
The University of Mississippi (Ole Miss)
Southern Methodist University (SMU)
Samford University
No installations will be performed at any school not listed above. It is the applicant's responsibility to confirm their school is on this list prior to submitting a deposit.
3. Non-Refundable Deposit
All deposits are final and non-refundable under any circumstance, including but not limited to the following:
You are not selected as a client;
You change schools, transfer, or otherwise enroll at an institution not listed above;
You change your mind, cancel, or no longer wish to proceed;
Your circumstances change (housing assignment, roommate changes, budget, etc.).
By submitting a deposit, you acknowledge and agree that no refund will be issued for any reason.
4. Application of Deposit
If you are selected as a client, your deposit will be applied as a credit toward your total design fee. It is not an additional charge on top of the design fee.
Governing Law; Jurisdiction; Venue
This Agreement, and any dispute, claim, or controversy arising out of or relating to this Agreement or your deposit, shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of laws principles. Subject to the Arbitration provision below, you agree that any dispute not subject to arbitration (including any action to compel arbitration or enforce an arbitration award) shall be brought exclusively in the state or federal courts located in Madison County, Mississippi, and you consent to the personal jurisdiction of such courts and waive any objection to venue there.
You further agree that this Agreement is entered into in Mississippi, that payment is accepted and processed in Mississippi, and that the services contemplated herein are coordinated and administered from Mississippi, regardless of your state of residence or the location of the school where installation may occur.
Binding Arbitration; Waiver of Class Action
Any dispute, claim, or controversy arising out of or relating to this Agreement, your deposit, your application, or the services (or non-provision of services) of Mary Margaret Designs, shall be resolved exclusively by binding arbitration, rather than in court, except as set forth below.
1. Arbitration Administrator and Rules
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. Information about the AAA and its rules is available at www.adr.org.
2. Location
The arbitration shall be conducted in Madison County, Mississippi, unless you and Mary Margaret Designs agree otherwise, or unless applicable law requires a different location.
3. Individual Basis Only — Class Action Waiver
Any arbitration under this Agreement shall be conducted on an individual basis only. You and Mary Margaret Designs agree that neither party may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator shall have no authority to combine or aggregate claims of more than one person, or to preside over any form of a representative or class proceeding.
4. Arbitrator's Authority
The arbitrator, and not any court, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration clause, including any claim that all or part of this clause is void or voidable.
5. Small Claims Exception
Notwithstanding the foregoing, either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies for that court's jurisdiction and remains in that court on an individual (non-class, non-representative) basis.
6. Fees
Arbitration filing, administration, and arbitrator fees will be allocated in accordance with the AAA Consumer Arbitration Rules, which are designed to limit the costs consumers bear in consumer disputes.
7. Opt-Out Right
You may opt out of this arbitration clause by sending written notice to info@marymargaretdesigns.com within thirty (30) days of the date you submit your deposit. Your notice must include your name, the email address used for your application, and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor Mary Margaret Designs will be bound by this arbitration clause, but all other parts of this Agreement will still apply, including the Governing Law; Jurisdiction; Venue provisions above.
8. Survival
This arbitration clause survives termination of this Agreement, non-selection as a client, and full payment of any design fee.
